The Yelp Delete service is provided by Loophole LLC, including its affiliates, assigns and agents (“Yelp Delete” or “we” or “us” or “our”) and the client (“user” or “you” or “your” or “customer”) enter this contract (“agreement” or “service” or “services” or “service agreement” or “terms and conditions” or “terms of service” or “refund policy” or “T&Cs”) on our website located at YelpDelete.com (the “website”). 

These terms and conditions are part of your service agreement with Yelp Delete and constitute a contract under which we provide you with services under terms and conditions that you accept. Your contract with us includes (i) these T&Cs, (ii) our Privacy Policy located at yelpdelete.com/privacy-policy, (iii) our Acceptable Use Policy located at yelpdelete.com/acceptable-use-policy.

You represent that you are at least the age of majority in your state of residence (twenty-one (21) years old or legally emancipated if you are a Puerto Rico customer) and you are legally authorized to enter into this agreement. You accept your agreement by doing any of the following: (a) giving us a written or electronic signature, or telling us orally that you accept; (b) placing an order on our website; (c) using the website after you make a change or addition; or (d) paying for the service. If you do not want to accept, do not do any of these things.

BY USING OUR SERVICES, YOU ARE ACCEPTING ALL TERMS OUTLINED IN THIS CONTRACT AND AGREE THAT YOU HAVE READ THEM ENTIRELY.

1- Refund Policy

1.1 General. Each of our services has their own specific refund policy. By using our services, you agree to the following refund and cancellation policy:

1.2 Delete Yelp Review. If we are unable to successfully delete (as defined in section 15) the specific Yelp review you signed up, paid for & listed on your order within forty-five (45) days from the time of full payment, you are eligible for a refund for that review (see section 5)

1.2.1 Example. If you pay for 3 Yelp reviews to be deleted and we are only able to have 2 of the Yelp reviews successfully deleted within 45 days from the time of full payment, you would be eligible to be refunded for one (1) review – which would be a $5,000 refund (assuming you did not use a coupon code or discount).

1.2.2 Delays/Exceptions. If we have the specific Yelp review successfully deleted within the 45-day guarantee and the review is reposted, we will have it deleted again for free if you have active monitoring. Reviews that are reposted are not eligible for a refund. 

1.2.3 Example of Exception. If we delete the Yelp review on day 38 and it is reposted on day 42, you will not be refunded if we are not able to have it deleted again by the 45th day. Although we will have it swiftly deleted again for free if you have active monitoring, we can not control when/if a fake review is reposted, which is why it wouldn’t be eligible for a refund.

1.3 Disappear from Yelp. If we are unable to successfully make the specific Yelp URL listed on your order disappear from the search results for the specific guaranteed keyword(s) listed on your order within forty-five (45) days from the time of full payment, you would be eligible for a refund on that keyword. 

1.3.1 Example. If you pay for 3 pages to disappear and we are only able to make 2 disappear within 45 days, you would be eligible to be refunded for one (1) page – which would be a $20,000 refund (assuming you did not use a coupon code and only selected one keyword). 

1.3.2 Delays/Exceptions. If we successfully make the Yelp page disappear from the search results for a specific keyword within the 45-day guarantee and it resurfaces (highly unlikely), you are not eligible for a refund for that specific keyword/page. But, we will make it disappear again for free if you have active monitoring. 

2- Guarantee

2.1 General. The guarantee period starts the minute we process and receive full payment for your order. The guarantee does not start when you place your order.

2.1.1 Paper Check Payments. We deposit paper check payments the day they are received from Monday thru Friday. Your order will be marked as paid 24 hours after your paper check is deposited (excluding weekends).

2.2 Guarantee Pauses. The guarantee period can pause based on certain factors including: chargebacks, disputes, reversal of payment or refusal to pay.

2.3 Guarantee Expiration. The guarantee period expires at 11:59PM (EST) on the date shown on your order. If the date shows as January 1, 2020 – that means your guarantee expires at 11:59PM (EST) on January 1, 2020.

3- Guaranteed Keywords

3.1 General. When signing up for our ‘Disappear from Yelp’ service, you can optionally pick up to 3 guaranteed keywords. 

3.2 Defined. Guaranteed keywords are the specific keywords/search phrases we guarantee to make your Yelp page disappear for and will define your order as ‘successful’ (see section 16). Guaranteed keywords are not the only keywords/search phrases your Yelp page would disappear for. In fact, you will more than likely disappear for all keywords/search phrases. Guaranteed keywords are for those who want to make 100% sure their Yelp page disappears for very specific search terms and want those specific terms attached to the contract.

3.3 Naming Guaranteed Keywords. When placing your order, list your guaranteed keywords (3 max) in the “Notes & Comments” section.

3.4 Picking Too Many Guaranteed Keywords. If you list more than 3 guaranteed keywords when placing your order, we will message you. If you do not reply within 24 hours from the time your order was placed, we will proceed with only the first 3 guaranteed keywords you listed. You authorize us to delete the extra guaranteed keywords you listed from your order.

3.5 Forgetting to Pick Guaranteed Keywords. If you forgot to add guaranteed keywords and your order was placed less than 24 hours ago, please reach out to your account manager immediately to add the guaranteed keywords to your order. After 24 hours, we are no longer able to add custom guaranteed keywords to your contract. Instead, we may pick 3 guaranteed keywords for you, which will be reflected on your order.

3.6 Verifying Guaranteed Keywords. We use the Google Rank Checker provided by KeywordTools.org at https://www.keyword-tools.org/en/google-ranking-live-check/. You would enter one of your guaranteed keywords into the “Your keyword” blank and then you would paste your Yelp page URL into the “example.com” URL blank. After clicking the “Research” button and waiting for it to load, you will be presented with that specific ranking for the URL using that keyword. If the ranking shows as #-/- or anything higher than #50, that is a success per the contract.

3.6.1 Turn Off Personalization. You must turn off personalization to check the ranking. This is due to cached results that can take a little longer to disappear for you. For more detailed information on turning off personalization, please visit https://help.yelpdelete.com/en/articles/9984510-how-to-turn-off-personalization-to-check-guaranteed-keywords

3.6.2 Fallback. If it’s time to verify your guaranteed keywords (due to YelpDelete.com notifying you we were successful for a specific guaranteed keyword) and the Google Rank Checker provided by Keyword-Tools.org is not working for more than 6 hours, the guaranteed keyword position will be verified using https://smallseotools.com/keyword-position/ 

3.6.3 Fallback for Fallback. If it’s time to verify your guaranteed keywords (due to YelpDelete.com notifying you we were successful for a specific guaranteed keyword) and the Google Rank Checker provided by Keyword-Tools.org is not working for more than 6 hours – and – the Google Rank Checker provided by SmallSeoTools.com is also not working for more than 6 hours, the guaranteed keyword position will be manually verified by Yelp Delete.

4- Extended Guarantee Periods

4.1 General. Some clients enter an extended guarantee period longer than our typical 45 day guarantee. Extended guaranteed periods can be 90 days, 120 days, or more when signing up due to the number of reviews. If you have an extended guarantee period, your account manager would have discussed this with you ahead of time. The guarantee date is shown on your order.

4.2 Terms. All terms outlined in this contract remain the same and the only differentiator is the guarantee date, which is shown on your order.

5- Requesting Refunds or Extensions

5.1 General. If the guarantee date shown on your order has passed and we were not successful (as defined in section 15 & section 16) – you should receive an email from us automatically informing you of this. You are then able to request a refund or extend the guarantee period so we can continue working on your order without you missing the refund eligibility timeframe.

5.1 Extensions. When requesting a refund, you will also have the option to extend the guarantee period so we can continue to work on your order without you missing the refund eligibility timeframe (see section 5.3). The guarantee period can be extended by 30, 60, or 90 days – depending on what you select when submitting a request.

5.2 Eligibility. If your order is eligible for a refund or extension, you will see a “Refund or Extension” button on your order. To be eligible for a refund or extension, your order must not be marked as ‘success’ as defined in section 15 and section 16.
If you believe you are eligible for a refund or extension, but you do not see the “Refund or Extension” button on your order, please immediately contact your account manager using the chat at the bottom right corner of your screen.

5.3 Timeframe. Requesting a refund or extension must be done within 15 days (not business days) after the end of your guarantee date shown on your order. Any refund or extension requests submitted more than 15 days (not business days) after the end of the guarantee date are not valid and you will not be eligible for a refund or extension. There are no exceptions, extensions, additional grace periods, or delays to this term for any reason whatsoever. 

5.4 Accuracy. Please make sure you submit the request on time and with accurate information. Do not submit a request before you are eligible. Submitting inaccurate information will void the request.

5.5 How to Submit a Request. To submit a refund or extension request, please go to your eligible order and click on the “Refund or Extension” button. Your account manager can not request a refund or extension on your behalf. Emailed requests are not valid and will be void.

5.6 Request Review Time. Once a request is submitted, it can take up to 5-7 business days for us to review it. If approved, you will receive an email confirmation. If your order is successful during the request review period, you will not be eligible for a refund or extension.

5.7 Liability. If the guarantee period has passed, we were not successful, and you have not received a refund confirmation email – you agree not to hold us liable and further understand it is your sole responsibility to visit your order to manually request a refund or extension. If you believe you are eligible for a refund or extension, but you do not see the “Refund or Extension” button on your order, please immediately contact your account manager using the chat at the bottom right corner of your screen.

5.8 Refund Method. Refunds are paid by paper check only and mailed via USPS (United States Postal Service). We do not offer refunds via a credit or reversal to your credit/debit card for any reason.

6- Cancellations

6.1 General. After submitting your order, cancellations are not allowed for any reason other than an exact duplicate order (must be approved by Yelp Delete). By submitting your order, you agree to pay the full balance listed on your order, including any fees (should they apply).

6.2 Declined Orders. Yelp Delete can cancel or decline orders for any reason.

7- Transfers

7.1 General. Transfers are not allowed for any reason. 

7.2 Delete Review Transfers. If you sign up to have a specific review deleted, you can not contact us after signing up to change it to a different review. 

7.3 Disappear from Yelp Transfers. If you sign up to make a specific Yelp page disappear, you can not contact us after signing up to change it to a different Yelp page.

8- Chargebacks

8.1 General. You agree not to issue a chargeback or start a dispute with your card company/bank/financial institution, except in cases of fraud.

8.2 Chargeback Fees. If a chargeback or dispute is started, excluding cases of fraud, the guarantee period is paused as the funds are temporarily pulled from our account. Once the chargeback/dispute is canceled – the 45 day guarantee period is reset and begins again after you pay the $1,000 false chargeback fee. You agree to pay this fee if your payment is charged back or disputed. This rule applies to all payment methods including credit, debit, paper checks, cryptocurrency, escrow and wire transfers.

8.2.1 Example. It is day 25 and you are unhappy it is taking longer than planned, even though we are still within the guarantee period. So you decide to call your card company/bank to start a chargeback/dispute. We receive a notification on the 28th day that you issued a chargeback/dispute. We stop working on your case and provide this refund policy to your bank. Once your bank (or you) cancels the chargeback/dispute and the funds are returned to our account, we will begin working again and the 45-day guarantee is reset and begins again (after the $1,000 false chargeback fee is paid).

8.3 Fee Due Date. Any false chargeback fee must be paid within 3 days of being issued by us or you will trigger the ‘Refusal to Pay’ clause in section 12.

9- Coupons and Discounts

9.1 General. For 6 or more Yelp review deletions, bulk discounts are automatically applied in your cart.

9.2 Refund Amounts. If a coupon code is used or bulk discount is applied, the total coupon/discount is subtracted from your refund eligibility amount. 

9.3 Payment Method Discounts/Fees. Depending on the payment method you choose, additional discounts or fees are applied in your cart automatically when placing your order. Payment method discounts/fees can change at any time before you submit full payment.

9.3.1 Changing Payment Method. If you change your payment method, any associated payment method discounts will be removed and added to your order.

10- Fees

10.1 General. Specific fees are outlined in their respective categories.

10.2 Late Fees. Invoices not paid within 3 days from the minute you placed your order will be charged a compounding late fee of 5% per week.
After 21 days, past due invoices will be sent to a collection agency.

10.2.1 Discount Reversal. After your order is 1 week past due (7 days), any previous discounts, including payment method discounts, on your order will be voided and re-added to your total balance due. At this point, your 7-day compounding late fee will be based on the new higher order total.

10.3 Bounced Payment Fees. Any bounced checks or payments (example: checks drawn on insufficient funds) will be subject to a $1,000 fee and will be forwarded to collections. You agree to pay this fee if your check is returned.

10.4 Chargeback Fees. Any chargeback/dispute opened, except in cases of fraud, will be subject to a $1,000 false chargeback fee (see section 8). You agree to pay this fee if your payment is charged back or disputed.

10.5 Venmo Purchase Protection Fees. When you use Venmo to pay for your order, we provide a 5% discount. If you would like to use Venmo Purchase Protection, we are charged an additional fee, so your order will not be eligible for the 5% discount. If you use Venmo Purchase Protection and send your order total minus 5% – you will need to pay the remaining balance before your order is marked as ‘Paid’.

10.6 Collections. You agree that you are liable for and will pay for the order total plus all collection fees, even if your order has not been successfully completed or even partially completed yet. Your order and all collection fees must be paid before the guarantee period starts. The weekly compounding late fees will continue to be added until the full balance has been paid, even if your order was sent to collections.

10.6.1 Collections Means Refusal to Pay. Any account forwarded to collections will be marked as ‘Refusal to Pay’ (see section 12).

11- Payment

11.1 General. Payment is due within 3 days from the minute you placed your order.

11.2 Accepted Methods. Due to the nature of our business, we may be unable to accept certain payment methods you may prefer to use to pay with. If we do not accept your preferred payment method, even if we originally advertised that we accepted the payment method in question, you agree to make other arrangements to submit payment to Yelp Delete using one of our actively accepted methods.

After submitting your order, cancellations are not allowed for any reason other than an exact duplicate order (must be approved by Yelp Delete). By submitting your order, you agree to pay the full balance listed on your order, including any fees (should they apply).

11.3 Escrow Payments. Orders over $10,000 may be eligible to use Escrow as a payment method for a 20% fee. 

11.3.1 Confirming Escrow Order. When Yelp Delete successfully completes your order, we notify Escrow of this fact. You will then receive an email from Escrow asking you to click “Accept” to confirm we were successful.

11.3.2 Timeframe to Confirm with Escrow. You must click “Accept” to confirm the order with Escrow within 24 hours after Yelp Delete marks your order as successful. Failure to confirm (clicking “Accept”) with Escrow within 24 hours after Yelp Delete marks your order as successful will result in an additional fee of $2,000 per 24 hours.

11.3.3 Rejecting Escrow Order. If Yelp Delete successfully completes your order (see section 16) but you click “Reject” on the Escrow confirmation, you agree to a $10,000 fee if you are found to be wrong by a Yelp Delete mediator. If we have to get a judge involved, you agree to pay all Yelp Delete attorney fees regardless of the end decision. Failure to pay fees within 3 days will activate the ‘Refusal to Pay’ clause in section 12.

In other words, please contact Yelp Delete directly to discuss any issues before attempting any illegal/malicious action by falsely rejecting the order.

12- Refusal to Pay (“RTP”)

12.1 General. We hope it will never come to this. We start working hard on your order immediately after you sign up, even before you pay us. Whatever the reason, some clients decide they aren’t going to pay for their order (ex: some clients try to claim they are the reason a review was deleted or a Yelp page disappeared). 

12.2 Reverse Reputation Management. Should you decide not to pay your invoice in full (including any & all late fees), you give Yelp Delete (& all associates) complete and irrevocable permission to perform reverse reputation management services on social media & review pages for you, your company, your associates, and family. This includes, but is not limited to: posting multiple 1-star reviews from various accounts, performing SEO on your negative links to bring them up in the search results, posting public comments/articles, etc. 

12.3 Refusal To Pay Examples. The following are some examples of “refusal to pay”: 1) You do not respond to Yelp Delete’s debt collection attempts for a period of 7 days (not business days); 2) We successfully complete your order and you do not respond to Yelp Delete’s debt collection attempts for a period of 3 days (not business days); 3) You tell Yelp Delete you are not paying for your order; 4) You reverse a payment to Yelp Delete; 5) You demand to pay by a payment method we can not accept; 6) You attempt to renegotiate pricing after placing your order; 7) You claim that you will pay after we are successful; 8) Any other action Yelp Delete, in its’ sole and absolute discretion, interprets as a refusal to pay.

12.4 Liability. In the rare case we have to perform reverse reputation management due to your refusal to pay… you waive any & all legal claims against Yelp Delete (& all associates) including claims of defamation, libel, harassment, breach of confidentiality, etc. Further, you waive any & all legal claims against Yelp Delete (& all associates) on behalf of your company, family and associates including claims of defamation, libel, harassment, breach of confidentiality, etc.

13- No Liability for Damages

In no event shall we be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this service, even if we are aware of the possibility of such damages and known defects.

14- Security

14.1 General. We take the security of your Personally-Identifying Information seriously and use reasonable electronic, personnel and physical measures to protect it from loss, theft, alteration or misuse. However, please be advised that even the best security measures cannot fully eliminate all risks. We cannot guarantee that only authorized persons will view your information. We are not responsible for third-party circumvention of any privacy settings or security measures.

14.2 Passwords. We are dedicated to protecting all information on the Website as is necessary. However, you are responsible for maintaining the confidentiality of your Personally-Identifying Information by keeping your password confidential. You should change your password immediately if you believe someone has gained unauthorized access to it or your account. If you lose control of your account, you should notify us immediately. 

14.3 Locked Accounts. Our system automatically locks accounts for a variety of reasons, including, but not limited to: 1) our system detected unauthorized login attempts; 2) our system detected the wrong password was entered 5 times in a row; 3) our system detected unauthorized password reset requests; 4) our system detected irregular login activity; 5) our system detected two different accounts being accessed from the same computer; 6) you have not logged into your account within 30 days; 7) you have requested for your account and private information to be deleted. 

14.3.1 Unlocking Your Account. Once an account is locked, it must be manually unlocked by a member of the Yelp Delete Account Security Team by emailing [email protected]. Unlocking your account can take up to 3 business days.

14.4 Paper Only Account. For those who desire more extreme privacy, we can optionally delete your order & account data from our online system and only keep paper copies of your order & account data. If this is a preference of yours, please contact us (before or after placing your order) to discuss switching your account to non-digital/paper only.

Due to the additional work required to make your entire account ‘paper only’, a one-time fee of $1,000 is required. This fee must be paid in advance using any of our currently accepted payment methods (excluding ESCROW) before your account can be switched to ‘paper only’.

15- Success – Delete Yelp Review

15.1 General. A successfully completed order (also known as “success”) means you are not eligible for a refund. This is due to the amount of work that goes into filing for the deletion of a Yelp review. 

15.2 Success Defined. Any of the following reasons would define your order as a success: 1) A review was deleted or is not showing. This includes a reviewer’s profile being suspended/deactivated or if they delete/edit the original review; 2) You reach out to the review platform or reviewer after placing your order with us. This includes reaching out via phone, email, snail mail, social media, chat, or by flagging/reporting the review; 3) You reply to the review after placing your order with us; 4) You attempt to remove the review yourself after hiring us; 5) You “turn off” the reviews on your page, even temporarily; 6) You change anything on your Yelp page without prior written permission from us; 7) You hire, solicit or authorize another party to perform any work on your Yelp page.

16- Success – Disappear from Yelp

16.1 General. A successfully completed order (also known as “success”) means you are not eligible for a refund. This is due to the amount of work that goes into making your Yelp page disappear. 

16.2 Success Defined. Any of the following reasons would define your order as a ‘success’ or ‘successful’: 1) Your Yelp page no longer shows up when searching your company name in the Yelp search bar; 2) Your Yelp page no longer shows up in Google search results as the top 50 results for 1 or more of the specific guaranteed keywords (see section 3) you defined when placing your order; 3) You reach out to the review platform or reviewer after placing your order with us. This includes reaching out via phone, email, snail mail, social media, chat, or by flagging/reporting the Yelp page; 4) You attempt to remove the page yourself; 5) You change anything on your Yelp page without prior written permission from us; 6) You hire, solicit or authorize another party to perform any work on your Yelp page.

17- Active Monitoring

16.1 General. When we successfully complete your order, we set up monitoring to ensure it stays that way. This way, you don’t have to personally monitor for new Yelp pages or fake reviews being reposted.

16.2 Delete Yelp Review. Once we have the Yelp review successfully deleted in accordance with this contract – we set up monitoring on your page. This way, if the same review is reposted, we will have it swiftly deleted for free*. 

​16.2.1 *Free Active Monitoring. The monitoring & re-delete service is included free for 30 days (or 3 re-deletions) after we get the review initially deleted.
After 30 days (or 3 re-deletions), the continued monitoring & re-delete service is available for a monthly fee, if desired.
Please contact your account manager for more information and pricing.

16.3 Disappear from Yelp. Once we successfully make your Yelp page disappear in accordance with this contract – we set up monitoring for your company. This way, if your old Yelp page is republished or if a new Yelp page is created by someone – we are notified and will swiftly make the new Yelp page disappear for free*. 

16.3.1 *Free Active Monitoring. The monitoring & re-disappear service is included free for 30 days (or 3 re-disappears) after we make your Yelp page initially disappear.
After 30 days (or 3 re-disappears), the continued monitoring & re-disappear service is available for a monthly fee, if desired.
Please contact your account manager for more information and pricing.

16.4 Failure to Renew. If the free active monitoring has expired and you have not signed up for a paid active monitoring plan yet – you will not be eligible for the re-delete or re-disappear service. At that point, you would need to sign up at full price to have the review deleted or make the page disappear… even if it’s the same review or page. 

After the free active monitoring has expired/lapsed, you will be unable to switch to a paid active monitoring plan – so make sure you sign up for active monitoring before your free active monitoring plan expires. 

16.5 Missed Payments. Any missed or late active monitoring payments will immediately terminate your active monitoring account. Missed or late active monitoring payments will not trigger the ‘Refusal to Pay’ clause in this contract.

16.6 Pricing. Active monitoring plans range based on your specific situation.
On average, active monitoring is $500/per month/per review for our ‘Delete Yelp Review’ service and $1,500/per month/per page for our ‘Disappear from Yelp’ service. Discounts may be available if prepaid for 6 or 12 months. Please contact your account manager for more information and customized pricing.

16.6.1 Changing Conditions. If you are on a paid active monitoring plan and we determine that conditions have changed (example: the reviewer is creating hundreds of new accounts posting the same review) we reserve the right to increase the monthly cost of active monitoring without notice. We do not accept credit or debit cards directly, so we do not automatically bill your payment method. It is up to you to continue active monitoring or not. If cancelled, no previous payments or prepayments will be refunded for any reason.

16.7 Refunds. Active monitoring plans are non-refundable for any reason. 

16.8 Repost Defined. Yelp Delete, in its sole and absolute discretion, determines whether a review or page is considered a repost.

18- No Implied Warranties

Except as expressly set forth in this agreement, neither party makes any representation or warranty, express or implied, with respect to the subject matter hereof or the transactions contemplated hereby.

19- No Legal Advice or Services

Nothing contained in this agreement or the service constitutes legal advice. If you have any questions regarding your legal rights and legal obligations, you should consult with your attorney. You understand and acknowledge that Yelp Delete provides reputation, consulting, and SEO services only. We do not provide any legal services. We are not, nor have we ever been, licensed attorneys/lawyers in any state or jurisdiction.

20- Abuse of Support

20.1 General. Abuse of our team is not tolerated. We reserve the right, at our sole discretion, to limit or disable your use of some or all of the following forms of support including phone support, SMS/text support, live chat support, AI chat support, social media support, and email support. Abuse of our team includes, but is not limited to, 1) Contacting members of our team multiple times every day just to ask the same question again; 2) Verbal abuse; 3) Harassment; 4) Communicating threats.

20.2 Limited Accounts. If you are limited or disabled due to abuse of support, your order will remain active and you can contact us via email and wait for a reply, which can take up to 7 business days.
Note: This term of our contract is for actual abuse of our support channels and verbal abuse of our customer service team members. Although we have seen less than 0.1% of our clients fall into this category, we simply cannot allow it to continue.

21- Notifications

21.1 General. We use SMS and email notifications to send you important information regarding your account and order.

21.2 SMS Notifications. By placing an order and providing your cell phone number, you agree to receive SMS notifications from us regarding your account and order(s). 21.2.1 Opt Out. To stop receiving SMS notifications (not recommended), simply respond STOP to the SMS notification. We do not recommend opting out of SMS notifications as this could cause you to lose access to your account. Once you opt out of receiving SMS notifications, we are unable to opt you back in.

21.3 Email Notifications. By placing an order and providing your email address, you agree to receive email notifications from us regarding your account and order(s). We use your email address to send you important notifications such as: attempted login attempts; password resets; 1 time access codes; order receive; order update; order success; billing reminders; payment received; fee added; collections; other important updates. Email notifications may include confidential information.

You understand all emails we send come from a mailbox that is not monitored, so you agree not to reply to the email. If you do reply to the email, you understand that we will not receive it and/or attribute it to your order.

21.3.1 Opt Out. By placing an order and providing your email address, you agree and understand you can not opt out of email notifications.

22- Contact Methods and Account Manager

22.1 General. Due to the highly confidential nature of the reputation management industry, we do not have a full time customer service team answering questions. Instead, our knowledgeable reputation management experts (the ones actually doing the work) are the ones directly responding to any customer service requests. Due to this, it may take us a bit longer to reply to questions.

22.2 Help Desk. The easiest and fastest way to get answers to your questions is by visiting our help desk located at Help.YelpDelete.com.

22.3 Contact Methods. If you can not find your answer in the help desk, please contact us using the chat button at the bottom right corner of your screen. Our custom programmed AI bot will attempt to answer your question in detail. If our AI bot is unable to answer your question, it will forward it to a member of our team.

22.3.1 Reply Times. Generally, we try to respond to messages within 24 hours, excluding weekends and holidays. 

22.4 Dedicated Account Manager. With our ‘Disappear from Yelp’ service, you are assigned a VIP dedicated account manager who you can contact directly anytime using the chat button at the bottom right corner of your screen. All messages are assigned directly to your account manager. Reply times will vary, but are typically 10x faster than those without a VIP dedicated account manager.

23- Confidentiality

22.1 General. Both parties agree to keep all information, correspondence, and discussions related to this agreement and order strictly confidential. You agree not to disclose any conversations, communications, or details about the project to any third party, and this obligation will remain in effect indefinitely.

Similarly, Yelp Delete will maintain confidentiality regarding your information and project details. However, this confidentiality obligation will be waived solely for Yelp Delete if your order is marked as “Refusal to Pay,” at which point we reserve the right to disclose necessary information to enforce payment, pursue legal remedies, or activate “Reverse Reputation Management”, while you remain fully bound by this confidentiality agreement.

24- Indemnification

You agree to defend, indemnify, and hold us harmless from and against any and all losses, claims, liabilities, costs and expenses (including taxes, fees, fines, penalties, interest, expenses of investigation and attorneys’ fees and disbursements) as incurred, arising out of or relating to use of the service, breach of the agreement, or violation of any laws or regulations or the rights of any third party by you or any person on your account or any person you allow to use your service.

25- Applicable Laws and Dispute Resolution

25.1 General. We control and operate the Website from our offices in the United States of America. We do not represent that materials on the Website are appropriate or available for use in other locations. Persons who choose to access the Website from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. This contract and the relationship between you and us shall be governed by the laws of the United States and the State of North Carolina, without regard to its conflict of law provisions. All parties agree that in the event of any dispute with respect to this contract or any respective obligations hereunder, such dispute shall be settled by arbitration in the County of New Hanover, State of North Carolina, in accordance with the commercial rules of the American Arbitration Association. Any award rendered by the arbitrators shall be final and judgment may be entered upon it in any court of competent jurisdiction. Our failure to exercise or enforce any right or provision of this contract shall not constitute a waiver of such right or provision. 

25.2 Waiver of Jury Trial. By agreeing to arbitrate all disputes, Yelp Delete and you are both waiving any statutory and constitutional rights to a jury trial. To the extent allowed by law and to the extent the ADR process and this arbitration agreement is found to be unenforceable, Yelp Delete and you waive statutory and constitutional rights to a jury trial. Please be advised that there is no judge or jury in arbitration, and court review of an arbitration award is limited. The arbitrator must follow this agreement and can award the same damages and relief as a court.

25.3 Class Action Waiver. Any action, suit or proceeding arising out of or in connection with this Agreement shall be brought in the plaintiff’s or claimant’s individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. A judge may not consolidate or join the claims of other persons or parties who may be similarly situated. Neither you, nor any other customer, can be a class representative, class member, or otherwise participate in a class, consolidated, or representative proceeding against us. 

If any provision of this contract is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this contract remain in full force and effect.

Yelp Delete reserves the right to amend or modify its refund policy at any time.
